It is a draft on purpose. The law makes an agreement binding only after each of you gets independent advice from your own lawyer, who witnesses and certifies your signature. Arriving at that meeting with this document, decisions made, schedules complete, is what keeps the process fast and the legal fees focused on advice instead of admin.

4Two lawyers make it binding
You each take the draft to your own lawyer for independent advice, witnessing and certification. That step is required by law, and it is what makes the agreement enforceable.
Common questions
- Is the drafting tool really free?
- Yes, end to end: the interview, your partner's review and the PDF download. What you pay for is what the law requires anyway, each partner's independent legal advice and certification, which happens with your own lawyers.
- Is the downloaded document legally binding?
- Not yet, by design. A contracting out agreement is void unless each partner receives independent legal advice and a lawyer witnesses and certifies each signature (section 21F). The draft is built to make that certification step as fast as possible.
- Can both of us see everything?
- Yes. Everything either of you enters is visible to both, because full disclosure between partners is what makes an agreement like this hold up. The tool tells you both this before anything is entered.
- What if our situation is complex?
- Companies, farms, overseas property and trust dealings are recorded and listed in a Flagged Matters schedule for your lawyers rather than drafted by the tool. You still finish with a useful draft; the flagged items get proper bespoke advice.
